1.Identification of the entity in charge of the offer

2.Scope of application and acceptance of the general terms and conditions of sale (hereafter GTC)

2.1 Object of the GTC

The GTC apply to sales of Scentak products made through the online sales site and application: www.scentak.com.

2.2 Field of application of the GTC

These GTC apply exclusively to online sales of products delivered by Scentak (hereafter, the website) to customers with consumer status (hereafter, the consumer). Both the GTC and the purchase order constitute the only contractual documents, excluding any other document, handout, or photographs of the products. These GTC apply to customers in the GCC.

2.3 Availability and enforceability of the GTC

The GTC are available to the public on www.scentak.com. The GTC are binding on the customer, who accepts them before ordering by checking a box provided for that purpose. The validation of the order by its confirmation indicates the consumer’s acceptance of the GTC in force on the day of the order. The website ensures the storage and reproduction of the GTC.

2.4 Amendments to the GTC

The website reserves the right to modify the terms at any time. In case of any modification, the GTC shall apply from the date of the order.

2.5 Clause of the GTC

The nullity of a clause of this agreement shall not entail the nullity of the agreement in its entirety.

3.Products

Each product advertised in the catalog on the website is described. The photographs illustrating the products are not contractually binding.

4.Price

4.1 Sales price

Prices are indicated in AED, SAR, OMR, KWD, QAR, and BHD for each product advertised in the catalog, including taxes but excluding delivery costs and COD fees. These additional charges are mentioned before the approval of the order and are added to the total price. The full amount charged is the one shown on the order confirmation. The price in effect on the date of the order is the one that applies. In the case of promotions, the website will apply the promotional price to any order made during the promotion period.

4.2 Amendment

The website reserves the right to modify the prices of products offered at any time. The customer will be charged the prices in effect on the day the order is accepted.

5.Offer

5.1 Scope of application

Online sales offers are exclusively reserved for customers residing in the GCC, as referred to in article 2.2.

5.2 Duration

Online sales offers are valid, unless otherwise specified, as long as they are visible in the web catalog and within the limits of available stock.

5.3 Acceptance

The customer’s acceptance of the offer is validated by the confirmation of the order.

6.Order

6.1 Conclusion of the contract

To order, the customer, after filling their online basket by selecting the product and quantity, will proceed to checkout by providing information related to delivery and payment. Before confirming the order, the customer can review the details and total price and correct any errors. Confirmation of the order implies acceptance of these conditions of sale. An email will be sent to confirm that the order and payment have been validated.

6.2 Cancellation of an order

Cancellation of an order must be made before the shipment of the product. The customer must contact customer service by email at info@scentak.com, via the chatbot on our website, or message us through Instagram @scentakofficial, from Monday to Friday, 10 am to 5 pm UAE time. Every cancellation request is subject to the website’s acceptance.

6.3 Validation of the order

Scentak reserves the right to refuse any order for legitimate reasons, including from a customer involved in legal proceedings related to a previous order, one who does not respect the conditions of sale, or one engaged in fraudulent activity.

6.4 Unavailability of products

In the event that products are unavailable, the customer will be immediately informed and may either choose another product or cancel the order. In case of disagreement or cancellation, the customer will be reimbursed promptly if the bank account has already been debited, or no later than 30 days after payment.

7.Contract

The contract consists of the order and the GTC.

8.Secure payment system

The website provides a secure payment system for credit cards, debit cards, and cash on delivery. Buy now, pay later options, such as Tabby and Tamara, are also available.

9.Delivery

9.1 Delivery delay

In the event of delays, damage, total or partial loss, or any other issue during delivery, the customer must take legal action against the carrier. The website bears no responsibility for these issues. We advise customers to check the packaging and contents upon receipt and refuse delivery if anomalies are identified. Any reservations should be noted on the delivery docket, and a registered letter with acknowledgment of receipt must be sent within three days of delivery. Signing the delivery docket without reservations signifies acceptance of the parcel. The website cannot be held responsible for any deterioration of product quality or packaging due to shipment. Claims made beyond 10 days after delivery may not be processed.

9.2 Conditions of delivery

The order will be sent to the address indicated by the customer on the purchase order.
